Membership Terms and Conditions

This document outlines the rules, regulations, rights and responsibilities of the member for the duration of Membership at The Iron Stronghold

It also outlines the member's responsibilities in regards to authorization to EziDebit Pty Ltd to debit the member's chosen bank account for fees, as explained in these Terms and Conditions.
This document must be read in full and understood by members before signing the Membership Application Form.

Terms and Conditions

Your membership is governed by this Agreement.

The Iron Stronghold reserves the right, in its sole discretion, to amend this Agreement.

  1. Membership

    1. Your membership permits you: use of The Iron Stronghold’ premises, facilities, equipment and services. Membership can be Paid in Advance ( PIA) or Direct Debit ( DD) recurring payments by way of EziDebit Pty Ltd.
    2. You must provide The Iron Stronghold with any changes to your details, which are relevant to your membership in writing.
    3. Membership holds are available for;
      1. All direct debit and 3 month PIA memberships can be placed on hold (as long as no fees are due)
      2. A paid in advance membership for 3 months or less does not qualify to be placed on hold.
      3. You can place your membership on hold for a minimum of 7 days and a maximum of 8 weeks (56  days) within a 12 month time period.
      4. To place your membership on hold, you must provide written notice to the The Iron Stronghold. If you can’t get into The Iron Stronghold during staffed hours to give written notice, an email stating the start and finish dates can be sent directly to the The Iron Stronghold.   1. Access

    1. All members must swipe their Card every time they attend the Centre including outside staffed hours and if gaining access alongside another member.
    2. At no stage are you permitted to give your Card to non-members to allow them to access the Centre.
    3. If a member would like to train with a non-member they must attend within staffed hours and must pay the casual membership rate.
    4. If the roller doors are open, all members must scan in upon entering the gym.
  1. Gym Rules and General Conditions of Entry

    1. Please read carefully. Members must comply with the following conditions and rules or potentially face restriction or termination of membership:
    2. Entry will be refused or a person requested to leave the Centre if the person:
      1. Is abusive or whose behavior and language is rude or threatening to other members.
      2. Is under the influence of drugs or alcohol.
      3. Is smoking in or within the boundaries of the Centre and the car park.
    3. Weights and equipment must be returned to their correct place after use
      1. Failure to return weights may result in having to vacuum a section of the gym.
    4. Gossiping and disrespectful comments about other members is prohibited within the premises.
    5. No member is too strong or important to work in and share equipment with another member.
    6. Deviations from paid programming workouts are discouraged.
    7. Members are not to provide any coaching to other members.
    8. Members are not to provide any recommendations or changes to programming to other members.
    9. Members are not to provide technique advice to other members.
    10. If a Member breaches section 3.b,c or d of this agreement the Member acknowledges that:
      1. they accept responsibility and liability on their personal behalf for any injury, loss or damage attributed to the Member whether or not caused through the negligence of The Iron Stronghold;
  1. Minors

    1. Minor means members under the age of 18.
    2. All Minors must have a parent or legal guardian agree to the terms of this Agreement. All Minors must attend The Iron Stronghold to obtain a membership.
  1. Lights

    1. All members training after hours during night time must turn the lights on upon entering the gym. There will be a sensor light that allows access.
    2. The light switches are located at both exits of the building.
    3. Members agree to turn off lights upon exit of the building if they are the last member training.
    4. The light located against the toilets is to be left on.
    5. If a Member breaches section 5.d of this agreement the Member acknowledges that:
      1. they accept responsibility for the lights being left on and;
      2. If the member repeatedly leaves lights on after hours their training session they will:
        1. Be charged a $10 fee for repeatedly leaving the lights on. Which will be charged to the Member in the following ways:
          1. For a Member who holds a DD Membership, this amount will be deducted from their payments; and
          2. for a Member who holds a PIA Membership, the Member will receive an invoice for this amount;
    6. The Iron Stronghold may restrict or terminate your membership for repeatedly breaching this section.
  1. Shower and Toilets

    1. If you are utilizing the showers whilst at the gym you must respect that others may need to use the facilities.
    2. Members are allowed 3 minutes of shower time per visit.  
    3. The Iron Stronghold may restrict or terminate your membership for repeatedly breaching this section.

  1. Child Creche

    1. The Iron Stronghold provides an area for younger children to play under direct supervision of the parent or guardian.
    2. The Iron Stronghold and its employees do not take any responsibility or liability for the supervision or care of minors whose parents or guardians are utilizing this area.
    3. If a minor is in a disturbed state, causing excessive noise or are disturbing the peace then you will be required to remove them from the premises immediately.
    4. You agree that any damage caused by minors shall be the parent or guardian's responsibility and you will be liable to pay for damage caused.
    5. Minors are the responsibility of the parent and/or Guardian. If they are removed from the designated area and are injured by way of any means, The Iron Stronghold negates all liability in these circumstances.
    6. The Child Creche exists to allow parents of young children to train, this is not a supervised service. The child’s parents and guardians must supervise children at all times and must remove any disgruntled children immediately.
    7. The Iron Stronghold may restrict or terminate your membership for repeatedly breaching this section.
  1. Parking

    1. Under no circumstances shall any member or associated party park anywhere that is not a dedicated car park to the premises. The dedicated car parks are along the retaining wall adjacent to the building.
    2. The Bidvest car park is not to be utilized at any time.
    3. All members must give way to all Bidvest trucks, cars, employees and customers at all times.
    4. All members must give way to anyone who requires the other sections of the building.
    5. Speed limit is walking pace.
    6. The Iron Stronghold may restrict or terminate your membership for repeatedly breaching this section.

  1. Damage to the gym

    1. Any Member who willfully or through their negligence damages the Centre, the equipment or its property will pay for the damage. Members are responsible for damages caused by their guests and children.
  1. Safety & Maintenance

    1. The Centre may from time to time as reasonably necessary:
      1. close off any part of the Centre or isolate any piece of equipment for repair, maintenance or safety reasons.
  1. Legacy Membership

    1. Members who were active at the time of closing of “Sapphire Coast Barbell” and agree to this Agreement are defined as a Legacy Member. A Legacy Member has the privilege of training at a discounted cost.
    2. The Iron Stronghold reserves the right to terminate a Legacy Member’s privileges in the event of the following:
      1. A PIA membership is not renewed prior to its expiry date;
      2. A DD membership is cancelled or terminated; or
      3. A member’s conduct is improper, harmful or illegal or they are found to be in breach of the gym rules.

  1. Payments

    1. You agree to pay all Membership Fees as set out in this Agreement and the Payment Provider’s Direct Debit Form.
    2. For a DD Membership you must make your payments on a fortnightly, or monthly basis in advance.
    3. For a PIA membership, you must pay your membership in advance in full for the duration specified.
    4. You must provide to The Iron Stronghold, a Payment Agreement authorising The Iron Stronghold’ Payment Provider to debit the Membership Fee due for each direct debit period from your Billing Account.
    5. You agree to pay any Admin Fees or transaction fees incurred by use of the Payment Provider in regards to the members direct debit account.
    6. The Iron Stronghold will endeavour to contact you by phone, sms, message or email to inform you of any overdue payments.
    7. A Member will be charged a $20.00 fee if their Access Card is damaged or lost and requires replacement.
    8. Additional fees (being bank charges or administrative charges incurred by the Payment Provider) may apply for any overdue or late payments.
    9. If there are excessive repeated failures to meet your payment obligations, your membership may be suspended or terminated. Any fees due will still be payable.
    10. The Iron Stronghold reserves the right, at any time, to adjust the Membership Fees charged to Members for use of the The Iron Stronghold facilities.
  1. Staffed Access

    1. Staffed Hours means the hours in which coaching will be available.
    2. The Iron Stronghold reserves the right to change the Staffed Hours at any time without notice.
    3. A Member may be subject to a Staffed Access only membership, which will only allow them to attend The Iron Stronghold during Staffed Hours.
  1. Access by Non-Members and Casual Visits

    1. All Casual visits outside of staffed hours are to be scheduled ahead of time to allow access to the facility.
      1. The Iron Stronghold can not guarantee access to the gym in these circumstances at anytime.
      2. Casual Members will have to agree to these terms & conditions.
    2. No Member is permitted to bring a non-Member into the gym without prior consent from The Iron Stronghold.
    3. If a Member breaches clause 12.b of this Agreement, the Member acknowledges that:
      1. they accept responsibility and liability on their personal behalf for any injury, loss or damage attributed to the non-Member whether or not caused through the negligence of The Iron Stronghold;
      2. the act of bringing a non-Member into the gym constitutes automatic acceptance by the Member to take responsibility of a casual pass for the non-Member. The Casual Fee, will be charged to the Member in the following ways:
      3. For a Member who holds a DD Membership, this amount will be deducted from their payments; and
      4. for a Member who holds a PIA Membership, the Member will receive an invoice for this amount;
    4. The Iron Stronghold reserves the right to terminate the membership of the Member who brings a non-Member into the gym.
  1. Orientation

    1. It is a condition of this Agreement that if recommended by The Iron Stronghold, you participate in a scheduled Coaching Orientation session before commencing a membership.
    2. The Iron Stronghold may suspend or terminate this Agreement in the event of unsatisfactory completion of the gym orientation prior to the commencement of exercise.
  1. Physical Condition

    1. It is your responsibility not to participate in any activity which may adversely affect any medical condition.
    2. You hereby state to the best of your knowledge, you do not have any physical, medical or other disability or condition which may be affected or aggravated by, or which may result in any sickness, injury or death to you as a result of, your use of the gym, the equipment or it’s facilities.
    3. If you have any health or medical concerns now or after you join as a Member of the gym, you must discuss them with your doctor before using the equipment or the gym.
    4. You acknowledge that The Iron Stronghold and its employees did not and cannot give you any medical advice at anytime.
  1. Video Surveillance

    1. For security purposes, The Iron Stronghold uses video surveillance equipment to monitor the gym on a 24 hour basis.
    2. Video surveillance is limited to the floor area only, and is not within the walls of the bathrooms or office.
  1. Equipment

    1. You understand and acknowledge that The Iron Stronghold purchases or leases the equipment from a third party and therefore does not manufacture any of the equipment used in the gym.
    2. You understand and acknowledge that The Iron Stronghold is providing recreational services and may not be held liable for defective products or equipment.
  1. Liability for Property

    1. The Iron Stronghold is not liable to you for any personal property that is damaged, lost, or stolen while on or around the gym including, but not limited to, a vehicle or its contents or any property left in a locker or mobile phone device.
    2. If you cause damage to the gym or any equipment you are liable to The Iron Stronghold for its cost of repair or replacement.
  1. Release and Indemnity

    1. The Iron Stronghold is entitled to ask you to agree to exclude, restrict or modify its liability for death or any personal injury suffered by you on gym premises, or from the use of our facilities or equipment.
    2. If you accept this Agreement, you agree to restrict the liability of The Iron Stronghold if you are killed or injured, with the result that compensation may not be payable if you or a third party suffers death or personal injury.
    3. The Iron Stronghold may refuse to provide you with the services if you do not agree to exclude, restrict or modify your rights by accepting this Agreement. Even if you accept this Agreement, you may still have further legal rights against The Iron Stronghold.
    4. A parent or legal guardian of a child who acquires recreational services for the child cannot legally agree to exclude, restrict or modify the child's rights.
    5. You use the facilities provided by The Iron Stronghold at your own risk and acknowledge that the use of the gym may involve risk of injury, whether caused by you or another party. By accepting this Agreement you agree that The Iron Stronghold will not be liable for any loss, injury, damage or theft of property, belonging to or brought onto gym premises by you, or for any death, personal injury or illness on gym premises, or from using our facilities or equipment.
    6. This release does not apply if your death or injury results from gross negligence on our part.
  1. Risk Warning

    1. The Iron Stronghold warns that whilst you are on our premises using our gym you are at risk of suffering physical harm or personal injury including broken bones, soft tissue injuries, joint injuries, permanent disability or death. These injuries may occur from you:
      1. slipping on wet flooring;
      2. being struck by weights;
      3. colliding with equipment, or other Members;
      4. engaging in strenuous exercise and activities; or
      5. incorrect use of equipment or gym,
      6. being struck by lightning.
    2. You acknowledge that any such injury may result not only from your actions but from the action, omission or negligence of others.
    3. You acknowledge and agree that the above mentioned injuries and potential causes of injuries are not exhaustive, and there are other unknown or anticipated risks that may result in injury, illness or death.
    4. You acknowledge that whilst every attempt is made to ensure that the recreational services and facilities provided by The Iron Stronghold are safe, there are some significant and inherent risks involved, and you agree that you are participating voluntarily at your own risk and responsibility, thereby exposing yourself to certain risks.
  1. Your Right to Terminate Your Membership

    1. You may terminate your membership at any time:
    2. You must provide a request for termination of your membership in writing to The Iron Stronghold.
    3. You must pay for a minimum of one month of membership fees before you may terminate your membership.
    4. The Member has a right to continue attending the gym until the Member’s prepaid period expires.
    5. in relation to PIA Members:
      1. if you do not renew your PIA membership by the renewal date, your membership will automatically expire.
  1. The Iron Stronghold’s Right to Restrict or Terminate Your Membership

    1. The Iron Stronghold may restrict your membership at any time on the following basis:
      1. Concern for the health and/or safety of the Member; or
      2. Non-compliance, improper or harmful conduct engaged in by the Member.
      3. Non-compliance with the Gym Rules and Conditions as outlined in Section 3.
    2. The Iron Stronghold may terminate your membership at any time on the following basis:
      1. you fail to make any payments of your Membership Fees;
      2. The Iron Stronghold reasonably suspects that you are engaging in illegal activity in the gym;
      3. you fail to follow any of the gym Rules, or violate any part of this Agreement; or
      4. your conduct is improper or harmful to the best interest of The Iron Stronghold Members.
    3. The Iron Stronghold will not refund any unused portion of your fees.
    4. Upon termination of your membership by The Iron Stronghold, you will cease to have access to the gym. Any money owing to The Iron Stronghold when your membership ends, remains immediately due and payable.
    5. Upon termination of your membership by your election, you may continue to use the gym for any period that you have paid in advance. You will cease to have access to the gym once any period you have paid in advance expires.
